Canadian Bill of Rights

Federal laws of Canada

Oh, for the love of fuck.

Booze manufacturers are upset that the Crown Corp/LCBO are now enforcing a contractual clause stating that they would not sell to other provinces for less than they sell to Ontario.

They're saying that sudden enforcement is 'unfair.'

Look, I'm not a fan of the LCBO as a whole, just as I'm not in favour of any monopoly. But a contract does not typically compel exercise of enforcement in the case of a violation. It lays the groundwork for measures to be taken in the case of a violation if the aggrieved party so chooses. The Crown Corp did not so choose until recently, though it was within their rights.

And there are lots of reasons not to seek redress, starting with goodwill and court costs, and moving from there. But this is black and white. Exercising an option on the table after a period of letting it slide is normal.

I'm glad the judge agrees.

@Lexpedite

Nods. Yes, I do understand that. Thank you! 🙂

My point (possibly not made well--apologies, for lately I am more unwell than usual with chronic medical issues) is that we should be cautious about falling into the trap of accepting their framing as valid when it absolutely is NOT in a Canadian context.

IMO, we need to rely on facts more than ever in the face of opinion and pure fantasy.

A better explainer is here, if it helps:

There's no such thing as 'parents' rights'

Parents have a right to raise their children in accordance with their own values, but they don't have the right to override their children’s own rights.
