At a Senate hearing in November 2009, Senator Byron Dorgan, described the Native American recognition process as broken.
The Brothertown filed its petition for re-recognition in April 1980. Ten years later, in 1990, the Department of Interior (DOI) said the citizenship act of 1839 was not an act of termination but in 2012, DOI concluded citizenship act was a termination.
