This reminds me of the gay panic defense, a "get out of jail free" card where you could beat up anyone when you were able to convince the judge that you *believed*, the person was queer and you feared, they were in some vague form dangerous to you. I can see people just claiming that a woman wanted to abort and Republican justices would let them go uncharged.
