The casino of Saint-Vincent is in controlled administration.

AGI - The casino in Saint-Vincent is under judicial administration. The measure, requested by the Turin Prosecutor's Office and ordered by the court, represents the first application of the judicial administration tool to a gaming house, identified by investigators as the context used for a suspected money laundering scheme and illicit value exchange in execution of agreements of a criminal nature.

The decree, issued today, is the natural consequence of the investigations conducted by the PEF (Economic and Financial Police) Nucleus of Aosta, which had allowed the unveiling of a money laundering system centered around the Aosta-based casino, with the seizure last December of cash, bank accounts, financial assets, and real estate, totaling approximately 5 million euros against over thirty suspects, for various crimes: from organized crime to the issuance and use of invoices for nonexistent operations, passing through money laundering, receiving stolen goods, and corruption of public officials.

Illegitimate Conduct and Responsibility

Investigators believe that these illicit activities, carried out at the casino, flourished thanks to the unjustified inertia of the administrator and other executives, to the point that they hypothesize that the company, by mistake, had not developed an organizational structure “adequate and suitable to prevent” the commission of the crimes contemplated.

Specifically, deficiencies in the entity's organization emerged, as well as “the passive and facilitating attitude” of the same, which, in effect, allowed, firstly, the spread and, subsequently, the rooting of illicit phenomena, particularly corruption and money laundering, without preventing them in any way.

Omissions in Controls

The Public Prosecutor’s Office and the Guardia di Finanza (Finance Police) are convinced that the top executives of the casino, not directly involved in the contested crimes, despite having detected multiple warning signals, would not have taken any concrete and direct initiative, negligently overlooking their respective control and reporting obligations, among other things, provided for by the anti-money laundering regulations.

Judicial Administration

The Court has therefore ordered “tutelage” by two judicial administrators, appointed by the same authority, who for an initial period of one year will exercise specific powers of administration in order to eliminate the identified criticalities.

Agi: Ruby ter: domani il ritorno in aula a 16 anni dalla "notte di Kharima"

AGI - "La sentenza di primo grado arriva dopo 8 anni, vuol dire che il sistema ha fallito". Lo diceva l'allora pm Tiziana Siciliano, adesso in pensione, il 18 maggio 2022, cominciando la requisitoria del processo Ruby ter a carico di Silvio Berlusconi e di altre 28 persone concluso con le assoluzioni. E quanto a lentezza della macchina giudiziaria quella considerazione è ancora attuale.
16 anni fa la notte di Karima in questura, domani si apre un nuovo capitolo
Esattamente 16 anni fa, nella notte tra il 27 e il 28 maggio del 2010, Kharima El Mahroug venne portata in Questura a Milano per un furto e indicata da Silvio Berlusconi come "la nipote di Mubarak". Domani con inizio alle 9 e 30 nell'aula della seconda sezione penale della Corte d'Appello, in molti sentiranno il peso degli anni passati quando suonerà la campanella che aprirà un nuovo capitolo della saga giudiziaria nata dalle rivelazioni di 'Ruby Rubacuori' nel primo decennio del millennio. Ventidue gli imputati nell'appello deciso dalla Cassazione tre anni fa per chiarire il nodo giuridico della presunta corruzione in atti giudiziari dopo che la falsa testimonianza si è prescritta. Manca la figura attorno alla quale è ruotata tutta la vicenda, Silvio Berlusconi, assolto dall'accusa di avere corrotto i testimoni, il cui ruolo sarà comunque al centro delle ricostruzioni di accusa e difesa. 
Assente Ruby in aula
E non ci sarà nemmeno Ruby mentre è in dubbio la partecipazione di qualcuna delle donne che frequentavano il 'Bunga Bunga' ad Arcore e vivevano nelle residenze di via Olgettina messe a disposizione dal premier. La relazione scritta che sintetizza i passaggi principali di inchieste e processi è già stata depositata dal pm Luca Gaglio e dal sostituto procuratore generale Luca Poniz e non sarà dunque letta in aula.
Due le questioni di costituzionalità in campo
I rappresentanti dell'accusa esporranno le loro richieste già domani a meno che il collegio non accolga o si prenda del tempo per valutare le eccezioni annunciate da parte delle difese. Due in particolare saranno delle questioni di costituzionalità. Una riguarderà il fatto che ai testimoni non viene spiegato che non sono pubblici ufficiali, la seconda che gli imputati non possono proporre un eventuale patteggiamento in appello perché sono stati assolti.
Il Tribunale li scagionò perché gli imputati per falsa testimonianza e corruzione in atti giudiziari avrebbero dovuto essere ascoltati come indagati dal momento che esistevano degli indizi di colpevolezza e quindi affiancati da un difensore. La Procura ricorse direttamente in Cassazione saltando l'appello, una scelta che si rivelo' vincente perché gli ermellini, nel 2023, hanno rimandato gli atti a Milano.
E la Suprema Corte ha stabilito che i testimoni non avevano un 'diritto al silenzio' accogliendo la tesi del procuratore Roberto Aniello: "I requisiti formali della testimonianza risultavano tutti sussistenti: ammissione dei testi, citazione degli stessi, dichiarazioni rese previo impegno a dire la verità. La valutazione, successivamente intervenuta, della erroneità dell'audizione in qualità di testimoni degli attuali imputati non determina l'inesistenza giuridica della qualificazione come testimoni di soggetti che non erano nelle condizioni per acquisire tale qualità, né l'inesistenza giuridica dell'atto compiuto, cioè la testimonianza".
L'accusa, i regali di Berlusconi per indurre le testimoni alla menzogna
Nella discussione dell'accusa si torneranno a evocare i 4,1 milioni in bonifici, case e auto a una ventina di giovani donne da parte di Berlusconi per indurle, secondo l'accusa, a dire menzogne nel processo al Cavaliere. Il remake dovrebbe essere breve, massimo due-tre udienze, lontanissimi quegli anni in cui il Palazzo di Giustizia era assediato dai cronisti di tutto il mondo che vedevano sfilare giovani, bellissime donne in aula nel processo all'uomo più potente d'Italia per il quale il verdetto definitivo, dopo la condanna di primo grado, resterà per sempre quello di un'assoluzione definitiva dalle accuse di prostituzione minorile per Ruby, di concussione per presunte pressioni sulla Questura in quella notte di cui ricorre l'anniversario e di corruzione in atti giudiziari per i fatti di cui si ridiscuterà domani.

The last week of May offers summer-like weather. According to the Centro Meteo Italiano, the synoptic situation sees a robust high-pressure area dominating Europe, with ground-level maximums around 1030 hPa over central continental areas. Today’s day will see dry weather conditions across much of Italy thanks to the high-pressure system extending to the central Mediterranean. However, there is still a possibility of isolated showers or thunderstorms in the Northwest Alps, Northern Apennines, and inland Calabria and Sicily. The next few days will not see significant changes with prevailing stability throughout the day and some afternoon phenomena. A hot air bubble will continue to affect Europe, especially Western Europe, with positive thermal anomalies of up to 10 degrees for several days. In Italy, we will have temperatures above average, especially in the Center-North, with maximums that will not have difficulty exceeding +30 degrees. In the second half of the week, and in view of the weekend, we will have a gradual weakening of the high pressure with a greater probability of afternoon instability and a slow drop in temperatures.
