Agi: "L'autista del tram deragliato a Milano era al telefono poco prima dello schianto"

AGI - L'autista alla guida del tram 9 deragliato a Milano il 27 febbraio scorso sarebbe stato al telefono fino a dodici secondi prima che il mezzo andasse a schiantarsi contro un palazzo. La conversazione con un collega sarebbe durata 3 minuti e 40 secondi.
E' quanto emerge, secondo quanto anticipato da alcuni quotidiani, dalle indagini svolte dalla Polizia Locale nell'ambito dell'inchiesta della Procura. Più certezze si avranno quando sarà aperta la scatola nera.
I legali dell'autista del tram: "Non era al telefono" 
Secondo gli avvocati Mirko Mazzali e Benedetto Tusa la telefonata si sarebbe interrotta almeno un minuto e mezzo prima dello schianto. "La notizia non c'è - commenta all'AGI Mazzali -. Dodici secondi, e a noi in realtà risulta che sono di più, rappresentano un tempo lungo e comunque nel momento dell'incidente non era al telefono".
Le accuse per l'autista del tram 
Il macchinista è indagato per omicidio e lesioni colpose e ha sostenuto di avere perso il controllo del tram a causa di un malore. Nell'incidente persero la vita Ferdinando Favia e Okon Johnson Lucky e rimasero ferite una cinquantina di persone.
La Procura: "il deragliamento causato dalla velocità elevata" 
Secondo la procura, l'autista procedeva a "velocità talmente elevata da determinare il deragliamento della vettura, che si schiantava contro l'edificio posto all'angolo fra viale Vittorio Veneto e via Lazzaretto, cagionando un disastro ferroviario".
Il capo di imputazione per l'autista del tram
Nel capo d'imputazione si legge che l'autista del tram "ometteva di regolare adeguatamente la velocità del mezzo condotto mentre si trovava in prossimità di una fermata e dell'intersezione stradale fra viale Vittorio Veneto e via Lazzaretto" e con "negligenza, imprudenza e imperizia non si avvedeva che lo scambio ferroviario presente appena prima dell'intersezione citata era azionato in direzione 'sinistra' e ometteva di azionare il citato scambio in direzione 'diritto' e svoltava a sinistra a velocità talmente elevata da determinare il deragliamento della vettura, che si schiantava contro l'edificio posto all'angolo fra viale Vittorio Veneto e via Lazzaretto, cagionando un disastro ferroviario".

The driver’s lawyers: “He wasn’t on the phone”

The charges against the tram driver

The machinist is under investigation for manslaughter and causing injury and stated he lost control of the tram due to a medical episode. In the accident, Ferdinando Favia and Okon Johnson Lucky died and approximately fifty people were injured.

According to the Prosecutor’s Office, the driver was proceeding at “such a high speed as to cause the derailment of the vehicle, which crashed into the building located at the corner of Viale Vittorio Veneto and Via Lazzaretto, causing a railway disaster.”

In the indictment, it reads that the tram driver “failed to adequately regulate the speed of the vehicle while in the vicinity of a stop and the road intersection between Viale Vittorio Veneto and Via Lazzaretto” and with “negligence, imprudence and incompetence, he did not notice that the railway exchange located just before the aforementioned intersection was operating in the ‘left’ direction and failed to operate the exchange in the ‘straight’ direction and turned left at such a high speed as to cause the derailment of the vehicle, which crashed into the building located at the corner of Viale Vittorio Veneto and Via Lazzaretto, causing a railway disaster.”
