To be clear, a public-nuisance suit would face daunting odds. It might seem implausible on its face to say #ICE is a “nuisance,” especially before one accounts for the #ReneeGood & #AlexPretti killings. But #states need to reach for every possible tool to meet the moment. And the legal theory behind a public-nuisance ICE injunction stands on firmer ground than the #TenthAmendment suits filed in recent weeks by #Minnesota & #Illinois.

The 2A grants the People their gun rights in the context of their participation in the State Militia in defence of their home State. Against whom? Read on.
The Constitution, on the whole, expressly limits the Federal powers by granting only a few specific powers. These are called the "enumerated powers".
In contrast, the 10A reserves to the States those broad "general powers", so long as those general State powers do not conflict with the enumerated Federal powers.
When these contemporaneous amendments, #2A and #10A, are read in the context of the encompassing Bill of Rights, the textual tenor of the Constitution, and the historical setting, the original intent of the Framers of our #Constitution comes shining through: the Framers expressly chose to limit the #Federal powers so as not to impinge upon the #States' powers, and the regulated, armed Militia manned by the citizens of the State were to provide an armed defence against encroachments upon their home State's rights by the aggressive neighbouring States and by the overbearing Federal government.

In this video, Harry Litman discusses a preliminary ruling against the Department of Transportation. It is DOT's intention to withhold money from states that do not actively cooperate with federal law enforcement. Transportation funds. Law enforcement. It's hard to see any relevance of one to the other in this instance. For me, the essence of this court case is that the Trump Maladministration believes the executive branch has legislative branch authority (Spending Clause) and it believes that states do not have sovereignty when Donald Trump thinks they do not have sovereignty. If you watch and listen to this ten minute Harry Litman video, let's see what you think. I'll attach a capsule account of the Tenth Amendment of the United States Constitution. It is my opinion that we should go back to the eighteenth and nineteenth practice of capitalizing the first letter when we speak of the People. The People is not just a really big number of individuals. The People is one of the most fundamental principles of the United States of America.
