Delhi News: सुप्रीम कोर्ट ने बुधवार को कहा कि उत्तर प्रदेश का गुंडा और गैर सामाजिक गतिविधि रोकथाम कानून बहुत सख्त है। न्यायमूर्ति बीआर गवई और न्यायमूर्ति केवी विश्वनाथन की पीठ ने एक याचिका पर सुनवाई करते हुए ये बात कही।
दरअसल इलाहाबाद उच्च न्यायालय ने मई 2023 में गुंडा एक्ट के तहत लंबित कार्यवाही रोकने की मांग वाली एक याचिका खारिज कर दी थी। इस पर याचिकाकर्ता ने सुप्रीम कोर्ट का रुख किया था। अब सुप्रीम कोर्ट ने याचिका पर सुनवाई करने का फैसला किया है।
याचिका में लगाया गया पुलिस और न्यायिक मशीनरी के दुरुपयोग का आरोप
सुप्रीम कोर्ट ने इस याचिका पर बीते साल नवंबर में उत्तर प्रदेश सरकार से जवाब मांगा था। साथ ही शीर्ष अदालत ने याचिकाकर्ता के खिलाफ गैंगस्टर एक्ट के तहत किसी कार्रवाई पर भी रोक लगा दी थी। सुनवाई के दौरान वरिष्ठ अधिवक्ता गौरव अग्रवाल और अधिवक्ता तन्वी दुबे के जरिए याचिकाकर्ता ने तर्क दिया कि यूपी गैंगस्टर्स एक्ट के तहत उनके खिलाफ दर्ज प्राथमिकी निराधार है और पिछली प्राथमिकी से उपजी है। याचिका में कहा गया है कि यह प्राथमिकी दर्ज करना कानूनी प्रक्रिया का घोर दुरुपयोग है। इसमें तर्क दिया गया कि याचिकाकर्ता के खिलाफ गैंगस्टर्स एक्ट लगाना पक्षपातपूर्ण है और यह पुलिस एवं न्यायिक मशीनरी का दुरुपयोग है।
कानून के प्रावधानों की संवैधानिकता पर भी सुनवाई करेगा सुप्रीम कोर्ट
बुधवार को याचिकाकर्ता के वकील ने तर्क देते हुए कहा कि उनके खिलाफ पहले 1986 एक्ट की धाराओं में अवैध खनन का मामला दर्ज किया गया। एक ही आरोप में दो बार मामला दर्ज किया गया। गुंडा एक्ट की आलोचना करते हुए पीठ ने कहा कि इस पर विचार किए जाने की जरूरत है। पीठ ने ये भी कहा कि इस कानून के कुछ प्रावधानों की संवैधानिकता को चुनौती वाली एक अन्य याचिका पर भी अदालत सुनवाई करेगी।
इससे पहले हाई कोर्ट के समक्ष याचिकाकर्ता की ओर से पेश वकील ने तर्क दिया कि उसे गैंगस्टर अधिनियम के तहत दर्ज मामले में झूठा फंसाया गया है। उनके वकील ने हाई कोर्ट के समक्ष दावा किया था कि गैंगस्टर अधिनियम के तहत मामला केवल एक अन्य मामले के आधार पर दर्ज किया गया है जिसमें याचिकाकर्ता का नाम नहीं है।

Overturning Roe v. Wade and affirmative action in higher education had been leading goals of the conservative legal movement for decades. Over a span of 370 days, a Supreme Court reshaped by three justices nominated by President Donald Trump made both of those goals a reality. Last June, the court ended nationwide protections for abortion rights. On Thursday, the court’s conservative majority decided race-conscious admissions programs at the oldest private and public colleges in the county were are unlawful. Precedents that had stood since the 1970s were overturned. The court just ended a term in which ethical questions swirled around the justices and public trust dipped. There were other expected conservative decisions but also some notable surprises.
