Garlasco, the Milan Prosecutor's Office opens an investigation file following the complaint by Stefania Cappa.

The Milan Public Prosecutor’s Office opened a preliminary investigation file, model 45, without any suspects or charges, following a complaint filed by Stefania Cappa against lawyer Antonio De Rensis, journalist Alessandro De Giuseppe of Le Iene (The Hyenas), and former Carabinieri Major Francesco Marchetto of Pavia. The lawsuit, filed by Chiara Poggi’s cousin – who has never been investigated in the Garlasco murder investigation – hypothetically involves offenses such as incitement to commit crimes through defamation and slander, and aggravated defamation. The file marks a new step in the extensive legal and media dispute that has been ongoing for years surrounding the case.

The file opened in Milan is just one of the 79 currently on the table of Prosecutor Antonio Pansa. These are proceedings stemming from complaints and lawsuits filed not only by the Cappa sisters and their families, but also by the Poggi family, against journalists, YouTubers, bloggers, and other individuals, with charges ranging from defamation to stalking.

Much of this file is currently listed under model 44, meaning proceedings without suspects but with charges already identified. However, according to information emerging from legal circles, many positions will likely be formally defined in the coming weeks with the formal inclusion of names in the register of suspects, even as a result of the complaints filed, as a matter of due diligence to guarantee protection.

The file related to Stefania Cappa’s latest legal action will also follow the same procedure. It will be the Milan investigators who will assess whether and what charges can be formulated against the defendants, while the inclusion in the registers of suspects is expected to be imminent. “It will be the Milan judicial authorities – explained lawyer Antonio Marino, one of the lawyers for the Cappa family – to certify whether or not there has been a violation of professional or/and ethical duties by those who, to varying degrees, participated in this relentless campaign of denigration.”

Garlasco – “I don’t make deals and I will speak again,” insists Massimo Lovati, the former lawyer for Sempio, on the “machination” of 2017.

“Part of the 2017 investigation was dumped into today’s proceedings, so there’s a certain continuity, they could be interdependent.” With these words, Massimo Lovati, former lawyer for Andrea Sempio, reiterated the claim of a supposed “conspiracy” behind the investigation that nine years earlier involved the 38-year-old in the Garlasco crime. Lovati spoke this morning upon entering the Milan Courthouse, where the pre-trial hearing of the case against him for defamation was held. The accusation stems from statements made on March 13, 2025, outside the Montebello Barracks in Milan, when he described the 2017 investigation into Sempio as “the result of a conspiracy orchestrated by the defense of the Giarda Studio.”

Accompanied by his lawyer, Fabrizio Gallo, the 73-year-old from Vigevano denied the possibility of alternative proceedings. “I don’t plea bargain, I don’t ask for a suspended sentence,” he stated, explaining that nothing would happen “nothing” during today’s hearing. However, another point drew attention: Lovati announced that “later” he might make further statements about the case that led to his trial. “I will speak about the 2017 conspiracy, that’s why I am here,” he told the reporters.

Lovati was investigated and subsequently indicted by the Milan Public Prosecutor Fabio De Pasquale following a complaint filed by the lawyers Enrico and Fabio Giarda, children of Professor Angelo Giarda, the historic lawyer for Alberto Stasi, who was definitively convicted for the murder of Chiara Poggi.

The indictment charges Lovati not only with the statements made outside the Command Legion Carabinieri Lombardia barracks, where Sempio had gone for DNA collection after the reopening of the investigation, but also with a long series of statements made to national television and broadcasts. According to the prosecution, Lovati allegedly told viewers of Tg1, Tg2, Tg3, SkyTG24, La7, Mediaset, Milano Pavia Tv, Fanpage, Antenna 3 and programs like Quarto Grado, Le Iene and Mattino Cinque that “the 2017 investigation” was “the result of a manipulation organized by the investigators of the defense studios of Stasi,” adding that Sempio’s DNA had been “clandestinely taken” in 2016.

Lovati’s statements come as the Garlasco case continues to reignite the debate between the defense teams involved in the new investigative phase. In an interview with Repubblica, Antonio De Rensis, defender of Alberto Stasi alongside lawyer Giada Boccellari, reiterated that the defense’s work will continue without hesitation. “No judicial action can slow me and my colleague Boccellari in trying to establish what we consider to be the truth: Alberto Stasi is innocent. Especially after reading the documents from Pavia,” the lawyer stated.

According to De Rensis, the new evidence in the investigation “further distances Alberto from the responsibilities established by the verdicts” and represents “an enormous, deeper and more complex job than I could have imagined.” The lawyer then harshly criticized certain reconstructions that emerged in the media debate surrounding the case. “I am dismayed to read and hear an investigated making suppositions of corruption about Napoleone and Civardi. And even more so certain of your colleagues giving the poor imbecile carabinieri. I believe it is more than legitimate to doubt these media,” he declared, adding: “From the moment I worked alongside Giada Boccellari, I imagined this would happen.” Finally, De Rensis commented on the complaint filed against him by Stefania Cappa, Chiara Poggi’s cousin. “I keep to myself what I think. Certainly, when she made her report public, I defended myself on TV with Milo Infante: I believe I have the right to do so,” he concluded.

Il Tempo: Garlasco, parlano le amiche di Chiara: chi andava in camera sua e la mail del "piccione"

Chiara Poggi aveva detto alle sue amiche che gli amici del fratello Marco entravano in camera sua per usare il suo computer. Circostanza che la seccava. Lo riporta Repubblica nell'ambito delle nuove indagini sul delitto di Garlasco. Il quotidiano riporta le testimonianze di alcune sue amiche secondo cui la ragazza era  "molto innamorata" di Alberto Stasi e che "tra loro non c'erano particolari problemi".

Maristella Gabetta, ex vicina di casa di Chiara, ascoltata un anno fa dagli inquirenti che indagavano su Andrea Sempio alla domanda "conosceva qualche amico di Marco?" rispondeva: "Di persona no, sapevo di qualcuno che frequentasse la casa per giocare ai videogame con Marco, me ne parlava Chiara (...) si lamentava soprattutto che questi amici andassero anche in camera sua a giocare con il pc".

La donna dice che è una "cosa plausibile" che Chiara avesse dei video intimi  suoi e di Alberto nel pc e smentisce che potesse aver interesse per qualche altro ragazzo, come poteva far pensare la famosa mail in cui parlava di un "piccione": "Mi sento di escludere che potesse riferirsi a qualcun altro perché era troppo innamorata di Alberto". Un'altra vicina di casa nega che ci sia stata una discussione il giorno prima del delitto tra Chiara e la cugina Stefania Cappa. Una ex collega definisce la vittima "molto gelosa" del fidanzato ed esclude la presenza di altri uomini, unica eccezione un collega con cui aveva preso appena un caffé come "piccola ripicca, un dispetto", tra innamorati.

Chiara Poggi had told her friends that Marco’s brother’s friends entered her room to use her computer. This circumstance irritated her. Repubblica reports this within the context of the new investigations into the Garlasco crime. The newspaper reports the testimonies of some of her friends, stating that the girl was “very much in love” with Alberto Stasi and that “there were no particular problems between them.”

Maristella Gabetta, Chiara’s former neighbor, who was questioned a year ago when investigators were looking into Andrea Sempio, in response to the question “Did you know any friends of Marco?” replied, “Not personally, I knew someone who frequented the house to play video games with Marco, Chiara told me about it (…) she especially complained that these friends also went into her room to play with the computer.”

The woman says it is a “plausible” thing that Chiara had intimate videos of herself and Alberto on the computer and denies that she could have been interested in any other boy, as the famous email in which she spoke of a “pigeon” might have suggested: “I feel I can exclude that it could refer to someone else because she was too in love with Alberto.” Another neighbor denies that there was an argument the day before the crime between Chiara and cousin Stefania Cappa. A former colleague describes the victim as “very jealous” of her boyfriend and excludes the presence of other men, with the exception of a colleague with whom she had just had a “small prank,” a bit of a “dispute,” between lovers.

Il caso Garlasco imperversa sul piccolo schermo ma non approderà, salvo colpi di scena, a “Belve Crime“, lo spin off del programma di interviste condotto da Francesca Fagnani. La trasmissione ha cercato di portare in prima serata su Rai2 Stefania Cappa, cugina di Chiara Poggi, ma l’avvocatessa milanese, oggi 41enne, avrebbe richiesto un compenso di circa 15 mila euro per sottoporsi alle domande incalzanti della conduttrice.
La trasmissione, fa sapere il sito di Davide Maggio che anticipa la notizia, avrebbe scelto di non riconoscere alla Cappa l’elevato cachet. Una decisione nata molto probabilmente anche dalla volontà di evitare polemiche, il servizio pubblico negli anni ha scelto di non riconoscere compensi ai protagonisti dei casi di cronaca nera.
Persona informata sui fatti nel corso delle indagini
È opportuno ricordare che Stefania Cappa non è indagata per il delitto di Chiara Poggi ma, come avvenuto per sua sorella Paola, è stata solo sentita come persona informata sui fatti nel corso delle indagini. Stefania Cappa è iscritta all’Albo degli avvocati di Milano dal 2012, è specializzata in diritto sportivo ed è sposata con Emanuele Airoldi, campione di equitazione e nipote dell’editore Angelo Rizzoli.
“Belve” tornerà in onda martedì 7 aprile, dopo le puntate standard saranno trasmesse le puntate “Crime”. Nei giorni scorsi è già stata registrata l’intervista a Raffaele Sollecito, legato all’omicidio di Meredith Kercher, la studentessa inglese uccisa a Perugia nel 2007. Lo scorso anno Fagnani aveva intervistato Massimo Bossetti, in carcere per l’uccisione di Yara Gambirasio.

The broadcast had sought to bring Stefania Cappa, cousin of Chiara Poggi, to primetime on Rai2, but the Milanese lawyer, now 41 years old, reportedly requested a fee of around 15,000 euros to answer the journalist’s probing questions.

The broadcast, according to the Davide Maggio website which anticipates the news, has decided not to pay the Cappa the high fee. This decision was likely also born from the desire to avoid controversy; public service has in recent years chosen not to pay compensation to the protagonists of black crime cases.

Informant in the investigations
It is worth remembering that Stefania Cappa is not under investigation for Chiara Poggi’s crime but, as with her sister Paola, she was only heard as a person with knowledge of the facts during the course of the investigation. Stefania Cappa has been registered in the Milan Bar since 2012, specializes in sports law, and is married to Emanuele Airoldi, equestrian champion and nephew of publisher Angelo Rizzoli.

“Belve” will return on air on Tuesday, April 7th, after the standard episodes, “Crime” episodes will be broadcast. In recent days, the interview with Raffaele Sollecito, linked to the murder of Meredith Kercher, the English student killed in Perugia in 2007, has already been recorded. Last year Fagnani interviewed Massimo Bossetti, who is in prison for the murder of Yara Gambirasio.
