Spinrilla Wants to Ban the Terms ‘Piracy’ and ‘Theft’ at RIAA Trial

Several RIAA labels have secured a major win in their court battle against the popular hip-hop mixtape service Spinrilla. A federal court in Atlanta has ruled that the company is liable for direct copyright infringement after it streamed thousands of infringing works. In addition, the mixtape service can't rely on the DMCA's safe harbor since it failed to register an official agent.
Popular mixtape platform Spinrilla wants the RIAA to be held liable for sending inaccurate takedown notices. Responding to a motion to dismiss from the music industry group, the mixtape service stresses that the RIAA was well aware of its wrongdoing and that it doesn't matter whether any files were actually removed or not.
The RIAA denies that it willingly sent false takedown notices to the mixtape service Spinrilla. In a new filing at a federal court in Atlanta, the music group refutes claims that it abused the DMCA takedown process. On the contrary, it believes that it had the right to remove a file which, according to Spinrilla, is clearly not infringing.
Popular hip-hop mixtape site and app Spinrilla has sued the RIAA for sending false takedown notices. The company believes that the music group relies on text searches, without properly checking if the content is infringing. The mixtape site informs the court that these faulty notices harm its goodwill and reputation, so is requesting damages in return.
