The case Saul Lliuya vs German coal major RWE got dismissed and case closed bc
*damage to Saul's property in Peru wd be too small: only a few centimetres of water would reach it
*the flood risk within next 30yrs is too small at 1%.
But: the court also ruled that RWE is indeed responsible and liable for all global damage from its CO2 !! Government permits for emissions do not free the company from responsibility.
And the court quotes the Keeling Curve from 1958ff as proof for the since-then-established fact of #climatechange and hence, liability of fossil fuel producers.
So, 🇩🇪Ahrtal victims: sue Exxon!
Global victims: sue Shell & RWE into hell!
And the township where Saul lives can also sue RWE – after the flood from the glacial lake has occurred, or once the flood risk is proven to be big enough.
