Ich bin kein Rechtsexperte und kann das nicht beurteilen, aber diese Praxis erinnert mich stark an die von Giorgio Agamben geprägte Figur des "Homo sacer". Im antiken Rom konnten Menschen für vogelfrei erklärt und legal getötet werden, was Agamben analog zu heute entrechteten Menschen wie etwa den Gefangenen in Guantanamo setzte. Er entwickelte diese These weiter mit der Analyse des Ausnahmezustands als heute immer häufiger anzutreffende Form staatlicher Ermächtigung.
Nach 9/11 haben die US-Streitkräfte Menschen in aller Welt im Rahmen des "Global War on Terror" entführt, gefoltert und ohne Prozess unbegrenzt inhaftiert, was durch den Begriff des "unlawful combatant" legalistisch gerechtfertigt wurde.
Das wurde damals zwar weltweit kritisiert, doch die Tendenz scheint eher dahin zu gehen, immer mehr Menschen zu ohnmächtigen Subjekten staatlicher Gewalt zu machen. Zweifellos werden Jurist:innen in den zuständigen Behörden dafür legale Titel finden.
So wird der Genozid in Gaza bis heute durch die Bundesregierung als eine Form der Selbstverteidigung für rechtens erachtet. Auch die neue Migrationsgesetzgebung der EU stelle die Rechte besonders vulnerabler Menschen zur Disposition und wird dafür allgemein gefeiert.
