In California, you’re probably aware of Prop 65. It’s the regulation requiring product labels for potential cancer causing elements and they appear to be everywhere. It is also known as the Safe Drinking Water and Toxic Enforcement Act of 1986.

As Congress descends further into self-parody, the temptation to treat the federal government as damage and route around it only mounts. It's a powerful, but imperfect strategy. On the negative side, it takes a lot of resources to introduce legislation into multiple states, and to win legislative fights in each.

I have a question for those who might know the history of Proposition 65: can anyone help me find why some folks might say the original cadmium levels were made up? Or can you point me to someone to ask?
The furthest I've gotten is that the cadmium recommendations were based originally on a 1981 EPA report (that I still need to read), and then ingestion limits were updated in 1997. And yet I've found several articles claiming the limits at first were made up.
