Respinte tutte le impugnazioni nella causa sull’eredità di Pino Daniele: la Corte d’Appello di Roma conferma il testamento come unico riferimento. Al centro del procedimento le richieste contrapposte del figlio maggiore Alessandro Daniele e della seconda moglie Fabiola Sciabbarrasi. I giudici hanno bocciato entrambe le ricostruzioni, tracciando un perimetro netto sulla successione.

Due i fronti della disputa. Da una parte, il primogenito chiedeva la restituzione di oltre 160 mila euro, sostenendo l’esistenza di un accordo verbale che non sarebbe stato rispettato. Dall’altra, la vedova rivendicava una quota più ampia dei diritti d’autore legati all’attività artistica del cantautore, in particolare quelli connessi. La sezione civile d’appello ha escluso entrambe le tesi. Sull’intesa verbale, i magistrati hanno rilevato l’assenza di prove concrete, giudicando infondata la richiesta economica. Sul fronte dei diritti, invece, hanno ribadito che l’unico riferimento resta il testamento, senza margini per interpretazioni diverse. L’atto, redatto nel 2012 e reso pubblico dopo la morte dell’artista nel 2015, stabilisce la divisione dei diritti in parti uguali tra gli eredi. Il documento distingue in modo netto tra diritti d’autore, diritti connessi e beni mobili e immobili.
Proprio questa distinzione ha guidato la decisione: i diritti connessi restano attribuiti ai figli e non si estendono alla seconda moglie, mentre per il resto del patrimonio vale la ripartizione già fissata. I diritti d’autore riguardano la creazione delle canzoni, mentre quelli connessi fanno riferimento alle registrazioni e alle esecuzioni. La vicenda, avviata nel 2017 e già definita in primo grado nel 2022, arriva così alla conclusione della fase di merito. Resta ora solo la possibilità di un eventuale ricorso in Cassazione, limitato però alle questioni di legittimità.

All appeals in the case concerning the estate of Pino Daniele have been rejected: the Court of Appeal in Rome confirms the will as the sole reference. The center of the proceedings are the opposing requests of the eldest son, Alessandro Daniele, and the second wife, Fabiola Sciabbarrasi. The judges dismissed both reconstructions, drawing a clear perimeter for the succession.
The Two Sides of the Dispute
There are two sides to the dispute. On one side, the eldest son was demanding the return of over 160,000 euros, arguing the existence of a verbal agreement that had not been respected. On the other, the widow was claiming a larger share of the copyrights related to the songwriter's artistic activity, in particular those connected. The civil appeal court excluded both theses. Regarding the verbal agreement, the magistrates noted the absence of concrete evidence, deeming the economic request unfounded. On the matter of copyrights, however, they reiterated that the will remains the sole reference, without room for different interpretations. The document, drafted in 2012 and made public after the artist's death in 2015, establishes the equal division of rights among the heirs. The document clearly distinguishes between copyrights, related rights, and movable and immovable property.
It was this distinction that guided the decision: related rights remain attributed to the children and do not extend to the second wife, while the rest of the estate follows the previously established division. Copyrights concern the creation of the songs, while related rights refer to recordings and performances. This matter, initiated in 2017 and already defined in the first instance in 2022, has thus reached the conclusion of the merits phase. There now remains only the possibility of a potential appeal to the Court of Cassation, however limited to issues of legitimacy.
