Cerco di capire il senso di questa riforma della magistratura, ma mi perdo. Che implica separare le carriere?

Gentile lettore, in parole povere separare la magistratura inquirente da quella giudicante significa che il pm diventerebbe un avvocato dell’accusa, non più un giudice tenuto a valutare equamente gli indizi a favore e a sfavore dell’inquisito. Oggi il pm indaga per la Giustizia, per scoprire la Verità. Domani, se passa la riforma, indagherà per provare la colpevolezza dell’imputato e sarà quindi tentato di nascondere o sottostimare gli elementi a suo favore. Se poi l’imputato è un protegé del potere politico, quel pm, essendo un “sottoposto” del governo, indagherà davvero? Ponga che un ministro lo chiami e gli sussurri: “Carissimo, quel nostro assessore inquisito è nu bravo guaglione, non ha fatto niente di male”. In quel caso il pm avrà il coraggio di indagare a fondo? Comunque, ciò detto, le consiglio il mio metodo pragmatico che non sbaglia mai. Per non sapere né leggere né scrivere, seguo le menti più illuminate. L’indefesso collezionista di busti del Duce, La Russa, voterà Sì. Santanché, inquisita per frodi alle casse dello Stato, voterà Sì. E a sinistra? Anche lì ho studiato il profondo pensiero di Piero Fassino, detto “Er profumiere”, per una disavventura in un duty-free shop consegnata alle cronache, e di Pina Picierno, quella che a Bruxelles nel pieno delle stragi di bambini palestinesi riceveva coi tappeti rossi una lobby dell’estrema destra israeliana. Fassino e Picierno voteranno Sì. Capito? Buon referendum.

Dear reader, in plain words separating the investigative judiciary from the judicial one means that the prosecutor would become an attorney for the prosecution, no longer a judge bound to evaluate fairly the evidence for and against the suspect. Today, the prosecutor investigates for Justice, to discover the Truth. Tomorrow, if this reform passes, he will investigate to prove the guilt of the accused and will therefore be tempted to hide or downplay the elements in his favor. If then the accused is a protégé of political power, will that prosecutor, being a “subordinate” of the government, really investigate? Let’s suppose that a minister calls him and whispers to him: “Dear friend, our assessor, the suspect, is a good boy, he did nothing wrong.” In that case, will the prosecutor have the courage to investigate thoroughly? Anyway, that said, I advise you my pragmatic method that never fails. To not know nor read nor write, I follow the most enlightened minds. The tireless collector of envelopes from Mussolini, La Russa, will vote Yes. Santanché, investigated for fraud against the state coffers, will vote Yes. And on the left? I have also studied there the deep thinking of Piero Fassino, nicknamed “the perfumer,” for a misadventure in a duty-free shop delivered to the chronicles, and of Pina Picierno, the one who in Brussels during the Palestinian children’s massacres received red carpets from an Israeli far-right lobby.
