Nella causa per violazione di marchio, depositata il 31 marzo presso il tribunale federale di New York, Denise Cesare, fondatrice del piccolo brand, afferma che Skims abbia lanciato la collezione “dopo aver ricevuto ripetute e inequivocabili notifiche”.
Secondo i documenti legali acquisiti da Page Six, l’accusa è pesante: si tratterebbe di una “decisione calcolata”, presa contando su risorse economiche, marketing e visibilità tali da “schiacciare” una realtà molto più piccola. “L’imputato credeva di poter semplicemente spendere di più, fare più marketing e resistere più a lungo di qualsiasi sfida legale”, si legge negli atti.
Il nodo è quello che in diritto si chiama “confusione inversa”: non è il piccolo a imitare il grande, ma il contrario. Con il risultato che il marchio più debole finisce oscurato. Secondo la denuncia, nei risultati online l’azienda di Cesare sarebbe ormai “di fatto invisibile”.
Nel frattempo, Skims è diventato un colosso da circa 5 miliardi di dollari e la collezione contestata, “Fits Everybody”, sarebbe tra le più redditizie, con incassi stimati tra i 700 e i 900 milioni. Cesare ora chiede che il marchio venga ritirato, oltre a un risarcimento per danni e profitti. Sul tavolo c’è anche un altro elemento: l’ufficio marchi statunitense avrebbe già respinto due volte la registrazione del nome da parte di Skims per rischio di confusione. Per ora, nessuna risposta ufficiale da parte di Kardashian o della sua azienda.

Meanwhile, Skims has become a behemoth worth around $5 billion and the contested collection, “Fits Everybody,” would be among the most profitable, with sales estimated between $700 million and $900 million. Cesare now asks that the brand be withdrawn, along with damages and profits. There’s also another element on the table: the U.S. Trademark Office already rejected Skims’ registration of the name twice due to the risk of confusion. So far, there has been no official response from Kardashian or her company.
