"A #conservative group that wants to restrict #transgender students' access to sports and school bathrooms is circulating a petition at polling places in Maine today. If they collect enough signatures, the measure could be on next year's ballot [unfortunately, they got enough signatures].

"The proposed referendum would require students to play on sports teams and use locker rooms and bathrooms that correspond with their biological sex at birth.

"The group #ProtectGirlsSports will need about 68,000 signatures by February to make it on to Maine’s 2026 ballot.

"It is the latest attempt to change Maine’s law, after several bills introduced last legislative session failed to amend the #MaineHumanRightsAct and ban transgender students from participating in sports teams aligned with their gender identities.

" 'Maine's Democrat legislature and governor has refused to comply with Title IX and has forced the hand of Mainers to take upon the task,' said Kristina Parker, the communications director of the Maine Republican Party.

"Parker said the #MaineGOP supports the citizen initiative.

" 'Many claim that only a handful of trans athletes doesn't matter, however there are thousands of female athletes who desire equal and uniform standards. It affects all of us. We want everyone to be safe and be able to play a fair game,' Parker said.

"Maine has faced ongoing pressure by the #Trump administration to comply with the president's executive order banning transgender athletes from competing on girls' sports teams. Earlier this year, the Trump administration accused Maine of violating anti-discrimination law and the state is involved in an ongoing lawsuit from the U.S. Department of Justice for alleged Title IX violations.

"#EqualityMaine Executive Director #GiaDrew said this initiative is another example of a national political agenda that is using kids.

" 'This initiative seeks to legalize discrimination against transgender students, a protected class here in Maine, who play sports and prevents trans students access to bathrooms and locker room facilities that best match their #GenderIdentity,' Drew said. "It would overturn decades of settled Maine law — law that has been tested in both the courts, including the Maine Supreme Court, and in the legislature on numerous occasions.'

"EqualityMaine is encouraging voters not to sign the petition.

" 'There are significant challenges to ensuring our public schools are funded and prepare young people to become productive adults in a wonderfully diverse global world, but singling out a marginalized group of children is beyond reproach and not part of the solution,' Drew said. 'In fact doing so makes schools less welcoming and safe for all kids.'

"At least six school districts in Maine have banned trans students from girls sports and locker rooms in defiance of the Maine Human Rights Act."

"Supporters of a citizens initiative that would prohibit transgender athletes in Maine from playing on teams that align with their gender identity say they have enough signatures to put the proposal on the November ballot.

"Organizers with Protect Girls Sports in Maine said Sunday they had already collected more than 78,000 signatures before their petition drive at #CalvaryChapel of Greater Portland in Westbrook.

"They only need about 68,000 validated signatures to get 'An Act to Designate School Sports Participation and Facilities by Sex,' on the ballot. Organizers said they were hoping to get 80,000, just in case signatures were invalidated during the review process by the Secretary of State's Office.

"While the proposed policy wouldn't explicitly ban #transgender students from participating in school sports, it would restrict them from playing on teams or using services that aligns with their gender identity, a category that is protected from discrimination under the #MaineHumanRightsAct."

#JayME (WGME) -- "The issue of transgender student athletes in high school sports is once again taking center stage at a Maine school district, with districts facing conflicting guidance from the federal government and the state on how to follow the law.

"A fiery school board meeting was held in Jay Thursday night, as residents and school board members expressed their opinions about the lawsuit the district is facing from the Maine Human Rights Commission.

"Earlier this year, they revised their district policies to recognize only two genders, male and female, under #TitleIX.

"That interpretation of the law aligns with President Donald #Trump’s policy but is at odds with a state law, The #MaineHumanRightsAct, which schools are required to follow.

"One Republican State Representative wants the district to follow the President's lead.

So, I briefly worked with Wayne Maines, #NicoleMaines' dad. I remember him telling me about his daughter, and how before Nicole's transition, #TransPeople weren't on his radar and was a bit taken aback. But being a good dad, he fully embraced her, and became one of her staunchest defenders. A class act!

"In January 2014, the Maine Supreme Court ruled in favor of Nicole Maines. At the time, she was in the fifth grade in Orono and identified as #transgender.

"She and her family say the school administration, her classmates and their parents were all aware that Maines was trans, and because of that, she had no problem using the bathroom that aligned with her gender identity.

" 'When I would introduce themselves to myself, I would say, 'Hi, I'm Wyatt, I'm a boy who wants to be a girl. What's your name?' And they'd say, 'Hi, I'm Ryan, I like trucks.' And it was on the same level of mundanity,' Maines said, describing her time in school.

"One day, that changed, and she was not able to use the girls bathroom anymore after another male student followed her into that bathroom.

" 'I went into the bathroom with another girlfriend of mine, and he followed me, and he didn't say anything to me, and he just kind of, like, made prolonged eye contact with me as he went into the second stall, and he use the bathroom, and it was like I was glued to that spot,' Maines said.

" 'I redid fifth and sixth grade, being there to make sure that she was OK. She never had a normal childhood,' Maines' mom, Kelly Maines, said reflecting on how much time she spent in the school trying to protect Nicole.

" 'It got so bad that Kelly had to quit her job at the University of Maine, and we moved her and the kids to Portland, and they lived in hiding in America,' Maines' dad, Wayne Maines, added.

"Eventually, Kelly contacted the #MaineHumanRightsCommission, and a lawsuit was filed. While the precedent was set in Maine more than a decade ago, the Maines family is concerned about upcoming legislation.

" 'Freedom matters, and they're taking freedoms away,' Wayne said.

"The state Legislature's Judiciary Committee is considering several pieces of legislation that would not allow transgender students to play sports with students who align with their gender identity or use the bathrooms or changing rooms of their choice.

"There is also a proposal to remove #GenderIdentity as a protected class from the #MaineHumanRightsAct.

"Maines lives in California and is pursuing an acting career. Her message to #TransKids is clear.

" 'Do not give in to their hatred,' she said.

"All of the bills looking to change the transgender rules in Maine are still waiting to be voted out of the Judiciary Committee. Once that happens, they will get a full vote, and likely a debate, on the House and Senate floors."

"The Trump administration is once again targeting Maine over its policies on transgender youth.

"The U.S. Department of Education – an agency the president is trying to abolish – announced Friday it has initiated an investigation into Maine’s Department of Education over allegations that school districts in the state are violating the Family Educational Rights Privacy Act (#FERPA).

"Specifically, the federal agency says school districts are allowing officials to create 'gender plans' that support a transgender student’s identity but then not making those plans available to parents.

"A similar investigation was launched in #California this week.

"Schools in Maine have been caught in a legal gray area between respecting student privacy and parents’ rights to be informed when it comes to children’s expression of gender identity while at school. Many youth live in families whose members might not be supportive of their gender identity.

"The Trump administration already has been investigating Maine for allowing #TransgenderAthletes to compete, something that is allowed under the #MaineHumanRightsAct but defies an executive order the president signed in February. This month, the administration found that Maine violated the federal law known as #TitleIX and warned that if the state didn’t make changes, it would risk referral to the U.S. Department of Justice and the potential loss of tens of millions of dollars in federal funding.

"The announcement from the U.S. Department of Education this week also warns that if any Maine district is found in violation of the federal privacy act, it could lose federal funding. It’s unclear how that will play out, though, because Trump is trying to eliminate the education department at the federal level.

"A spokesperson for the Maine Department of Education did not immediately respond Friday to questions about the investigation. A spokesperson for the Maine Attorney General’s Office declined to comment.

"Trump and his supporters have elevated transgender rights as the biggest battle in the country’s culture war and believe their messaging is a political winner, even beyond traditional party lines.

"In addition to his executive order barring transgender girls or women from competing in athletics, Trump signed another that says the federal government would only recognize two genders, male and female, a move some advocates said was designed to erase transgender individuals from existence.

"Many states, Maine included, have strong protections for transgender individuals."

"Leaders of the Maine Principals’ Association and Greely High School say they will not sign a proposed agreement from the Trump administration requiring Maine to stop allowing transgender athletes to compete in girls’ high school sports.

"The U.S. Department of Health and Human Services gave the Maine Department of Education, Maine Principals’ Association and Greely High School 10 days to sign a proposed resolution agreement in response to its findings that Maine violated federal #TitleIX law by allowing a transgender high school student to compete in a girls’ indoor track championship last month.
Thursday marks 10 days since the Maine entities were notified of #DHHS’ findings and presented with a proposed resolution.

"'In a letter to the community Thursday, the school board of School Administrative District 51, which includes Greely High School, said the district will not sign the agreement.

"'As stated during our Board meeting on March 6th, MSAD 51 will continue to follow state law and the #MaineHumanRightsAct (#MHRA),' the letter said. 'Compliance with the proposed (agreement) would be a violation of current Maine law.'

"A spokesperson for the #MPA said Wednesday it also will not sign the agreement. The MPA also sent a letter to DHHS last week saying the federal agency doesn’t have any jurisdiction over the private non-profit organization and asking it to dismiss its finding of a violation.

"'The Maine Principals’ Association is bound by the law, including the Maine Human Rights Act (MHRA), which our participation policy reflects,' the MPA said in a statement Wednesday. 'We are unable to sign any resolution agreement that would mandate we create a new policy that would violate the law and MHRA. As such, we have not signed and will not sign the resolution agreement sent by the federal Department of Health and Human Services.'"

"The Trump administration has said it could refer the findings to the U.S. Department of Justice if the agreement is not signed. U.S. Attorney General Pam Bondi has also threatened to sue Maine if the state refuses to comply with Trump’s executive order calling for a nationwide ban on transgender student-athletes.
