$15 minimum wage proposal won’t make 2024 ballot, as Michigan Supreme Court denies appeal
A ruling by the Michigan Supreme Court will prevent a petition effort to raise Michigan’s minimum wage to $15 an hour from appearing on the 2024 ballot.
In an order released Friday, the court said it was “not persuaded that it should grant the requested relief” to set aside a deadlocked decision by the Michigan Board of State Canvassers, which is made up of two Democrats and two Republicans and requires a majority vote for passage.
In a concurring opinion, Justice Brian Zahra said the court would not “second guess” the state canvassing process.

Viviano’s planned retirement from Michigan Supreme Court opens up race for 2024 GOP nomination
Just three days after Michigan Supreme Court Justice David Viviano announced he will not seek reelection this fall, a contest has already opened up to fill his seat on the GOP side.
In Michigan Democrats and Republicans nominate Supreme Court candidates at party conventions, although their party affiliation is not listed on the general election ballot.
Viviano, 52, is currently among three Republican-nominated justices on the court, along with Chief Justice Elizabeth Clement and Justice Brian Zahra. Democratic-nominated justices, meanwhile, hold the 4-3 majority: Justices Richard Bernstein, Kyra Bolden, Megan Cavanaugh and Elizabeth Welch.
Following Viviano’s late Friday announcement, both state Rep. Andrew Fink (R-Adams Twp.) and Michigan Court of Appeals Judge Mark Boonstra said they each planned to seek the Republican nomination to replace Viviano when his term expires at the end of the year.
Both Fink and Boonstra have demonstrated conservative views, such as in opposition to LGBTQ+ rights.

Former President Donald Trump will remain on the ballot for Michigan’s presidential primary following an order by the Michigan Supreme Court.
The unsigned decision released Wednesday morning did not rule on the merits of the case itself, saying that they were “not persuaded that the questions presented should be reviewed by this Court.”
While a vote tally was not provided, Justice Elizabeth Welch did offer a dissent, saying that the state’s highest court should have made a determination on whether Trump was eligible.
“Considering the importance of the legal questions at issue and the speed with which the appellants and the judiciary have moved, I believe it is important for this Court to issue a decision on the merits,” wrote Welch, one of four Democratic-nominated justices on the seven-member court.

Michigan Supreme Court hears arguments about changing minimum wage
The Michigan Supreme Court heard oral arguments in a dispute over the state’s minimum wage law that dates back to 2018, when the Michigan legislature decided to adopt increases in the minimum wage outlined in a ballot initiative, but did so with the intent to water them down. Since then, proponents for the initiative have challenged the legislature’s ability to do so, taking that fight to the state’s highest court on Thursday.
Advocates behind the 2018 proposal, which among other things would have raised the minimum wage to $12 by 2022, had enough signatures to get the issue on the ballot and allow voters to decide the issue, but instead, the legislature passed the initiatives, with leadership indicating from the start that the plan was to quickly amend the changes.
As things stand, Michigan’s minimum wage sits at $10.10, although it will increase to $10.33 on January 1, 2024. However, under the current law, it would not surpass $12 an hour until 2030, eight years after the ballot initiative would have achieved that.
Proponents of raising the minimum wage assert that the 2018 Republican-led legislature bypassed the rights of the people of Michigan to pursue ballot proposals.
