NonilexBenjamin Gutman, Oregon’s solicitor general, is making his first oral argument appearance before the justices on behalf of a group of #states that challenged the #tariffs.
#Kavanaugh asked, why would #Congress give the president the power to shut down #trade but not to take a less severe step, like impose a 1% tariff. That, he said, appeared to underscore the govt’s claim, creating an “odd donut hole in the statute.”
“It’s not a donut hole,” responded Gutman. “It’s a different kind of pastry.”

He said the Algonquin decision had a reference to #duties in a specific provision & an extended, clear legislative history describing the powers given to a president.

The court unanimously ruled for President Gerald Ford in a case about the imposition of #tariffs on oil imports, based on a different statute that also doesn’t mention the word tariffs.
“The court 9-0 rejected the argument” that the absence of the word tariff doomed Ford’s action, Kavanaugh said.

The Supreme Court appears ready to gut a key tool of the Voting Rights Act that's helped root out racial discrimination in voting for more than a half century. Such a change would boost Republican electoral prospects, particularly across the South. During 2 1/2 hours of arguments Wednesday, the court’s six conservative justices seemed inclined to effectively strike down a Black majority congressional district in Louisiana because it relied too heavily on race. If that is the outcome, it would mark a fundamental change in the 1965 voting rights law that was the centerpiece legislation of the Civil Rights Movement. The court is expected to rule by early summer in 2026.
Earlier, Justice #Kavanaugh gave #Louisiana’s lawyer an opportunity to push back on the #NAACP lawyer’s warning of “catastrophic” implications if the court strikes down §2 & the possibility that none of Louisiana’s 6 congressional districts would be majority-minority.
The state’s lawyer says, “I don’t know what our legislature would do,” but adds, “I don’t think the sky is going to fall.”
