#DougEvans made similar maneuvers during Pitchford’s trial, selecting a disproportionate number of #White #jurors compared with Black ones….By the time the judge had excused various potential jurors, the pool was composed of 36 White & 5 Black people.
Evans then used 7 peremptory challenges to strike 4 of the 5 #Black prospective jurors….He had marked up his juror list by placing a “W” next to the names of the White people & “B” next to the names of Black people, court records show.

It is the second time #SCOTUS has effectively thrown out a #capital case after the same #Mississippi prosecutor was accused of excluding #Black #jurors.

Pitchford was convicted of murder in 2006 & sentenced to death by a jury in Mississippi. It was his partner who fatally shot shop owner Reuben Britt with a .22-caliber pistol during the armed robbery, acc/to court filings. Pitchford, who was 18 at the time of the robbery, was accused of being an accomplice.

#SCOTUS Thursday sided with a Mississippi man who was sent to #DeathRow for his role in the murder of shopkeeper, upholding a lower court’s decision to vacate his conviction because of potential #RacialBias in #JurySelection.

In a 5-4 vote, the court found #TerryPitchford, who is #Black, did not have the opportunity to challenge the dismissal of 4 Black potential #jurors.

#ChicagoIL U.S. Attorney Andrew Boutros may have had personal contact with grand jurors in the prosecution against the group of Operation Midway Blitz protesters known as the “Broadview Six,” a defense attorney told a judge today.

“U.S. District Judge April Perry summoned lawyers into her chambers to discuss the question out of earshot from the public, my colleague Jon Seidel reports for the Chicago Sun-Times. Assistant U.S. Attorney Diane MacArthur said it should be discussed privately because it involved grand jury proceedings.

“The case fell apart, days before trial, after Perry discovered improprieties during grand jury proceedings. The alleged misconduct came to light only after a lengthy push by defense attorneys to get Perry to review unredacted transcripts of what occurred.

“It included a prosecutor improperly putting her personal credibility on the line to support criminal charges, a prosecutor having substantive contact with grand jurors outside the grand jury room and a prosecutor excusing grand #jurors who disagreed with the case”. [Chicago Sun-Times]
