LA NOTIZIA: Occhi su Gaza, diario di bordo #200

Domenica 3 maggio, Saif Abukeshek e Thiago Avila compaiono davanti al Tribunale di Ashkelon. Nessuna accusa formale è stata depositata. Il tribunale proroga la detenzione di due giorni, fino al 5 maggio. I due sono nel carcere di Shikma da quando le forze navali israeliane li hanno prelevati al largo di Creta il 30 aprile — oltre mille chilometri da Gaza, fuori da qualunque giurisdizione israeliana.
Le avvocate di Adalah, Hadeel Abu Salih e Lubna Tuma, hanno sostenuto che il procedimento è «fondamentalmente viziato e privo di fondamenti giuridici». Non esiste alcuna base legale per applicare extraterritorialmente i reati contestati — assistenza al nemico, contatto con agente straniero, appartenenza a organizzazione terroristica — ad azioni di cittadini stranieri in acque internazionali. Il tribunale ha ignorato l’eccezione.
Sabato 2 maggio le avvocate avevano visitato i due a Shikma. Avila ha dichiarato di essere stato «trascinato a faccia in giù e picchiato fino a perdere i sensi due volte». Abukeshek ha riferito di essere stato «legato alle mani, bendato e costretto a stare prono» fino all’arrivo in Israele. Adalah ha qualificato i trattamenti come «abusi fisici assimilabili a tortura».
L’ambasciata brasiliana ha incontrato Avila attraverso un vetro divisorio. I diplomatici hanno attestato lividi visibili e dolori alla spalla; nessuna cura era stata data. Il ministro spagnolo Albares ha dichiarato alla RAC1 che si tratta di «una detenzione illegale in acque internazionali, al di fuori di ogni giurisdizione israeliana». Sánchez ha chiesto a Netanyahu «la liberazione del cittadino spagnolo illegalmente detenuto».
Entrambi proseguono lo sciopero della fame. Nessuna accusa formale risulta depositata agli atti del Tribunale di Ashkelon alla sera del 3 maggio 2026.

On Sunday, May 3rd, Saif Abukeshek and Thiago Avila appeared before the Ashkelon Courthouse. No formal charges had been filed. The court extended their detention by two days, until May 5th. They have been in Shikma prison since Israeli naval forces took them aboard off Crete on April 30th — over a thousand kilometers from Gaza, outside any Israeli jurisdiction.

The lawyers at Adalah, Hadeel Abu Salih and Lubna Tuma, argued that the proceedings were “fundamentally flawed and lacking legal foundations.” There is no legal basis for extraterritorially applying the charges brought – aiding the enemy, contact with a foreign agent, membership in a terrorist organization – to the actions of foreign citizens in international waters. The court ignored the exception.

On Saturday, May 2nd, the lawyers visited the two at Shikma. Avila stated he was “dragged to the ground and beaten until unconscious twice.” Abukeshek reported being “handcuffed, blindfolded, and forced to lie face down” until arrival in Israel. Adalah characterized the treatment as “physical abuse comparable to torture.”

The Brazilian embassy met with Avila through a partition glass. Diplomats testified to visible bruises and shoulder pain; no medical care had been given. Spanish Minister Albares stated to RAC1 that it was “an illegal detention in international waters, outside of any Israeli jurisdiction.” Sánchez demanded from Netanyahu “the release of the illegally detained Spanish citizen.”

Both continue their hunger strike. No formal charges appear on file with the Ashkelon Courthouse as of the evening of May 3rd, 2026.
