【獨媒報導】涉民主派初選案的鄒家成正還柙荔枝角收押所，早前其友人將一本含有名畫《維納斯的誕生》的書籍交給他，但遭懲教署以「裸露」為由拒絕並退回。鄒昨（4日）入稟高等法院申請司法覆核，要求法庭裁定懲教署的決定違憲、不合法及不合理，侵害他受《基本法》保障的表達自由。鄒要求法庭推翻署方決定，批准他收取上述書籍。鄒提到，《監獄條例》第56條並無提及「淫褻」是退書的原因之一。據條例所指，退書的原因包括鼓吹暴力或逃獄，或涉及危害人身安全性質，而《教養》的內容不涉及上述之一。 司法覆核入稟人為鄒家成，建議答辯方是懲教署署長。鄒由大律師譚俊傑代表。 鄒家成：懲教署決定侵害其表達自由權利 鄒要求法庭裁定懲教署的決定是違憲的，因該決定侵害《基本法》及《香港人權法案條例》所賦予他的表達自由權利。鄒亦要求法庭裁定該決定不合法及不合理。另要求法庭頒令，懲教署需要批准鄒收取該書。 鄒指懲教僅告知書含淫褻內容 但無解釋原因 入稟狀指出，鄒家成的友人尤弘剛在今年9月3日申請引入書籍《教養：關於歷史、文學、藝術、音樂、哲學與世界風俗文化，你必須知道的事》（下稱《教養》）。該書是德國原著的譯本。尤當日告知鄒他已申請引入該書。惟兩天後當鄒向懲教人員查詢該書去向時，對方稱該書含有「淫褻內容」，因此他不能收取。職員亦沒有將該書內容展示予鄒。

Closing arguments in the trial of the 16 of the #HK47 who plead not guilty begin today in #HongKong. 10 of those 16 are on bail & arrived at court.
