In einem Punkt bringt das Gesetz aber einen Fortschritt: Es sieht die gestaffelte Einführung einer Solarpflicht vor. Damit setzt die Bundesregierung eine Vorgabe aus der europäischen Gebäuderichtlinie (EPBD, Artikel 10) um. Bundestag und Bundesrat müssen dem Gesetz noch zustimmen. Die Pflicht lässt sich neben der Photovoltaik auch mit Solarthermie erfüllen.
Die Vorgabe soll zunächst nur für öffentliche und gewerbliche Immobilien gelten. Neue Wohnhäuser folgen 2030. Neubauten müssen dem Gesetzesentwurf zufolge künftig so gestaltet sein, dass sich Solarenergie optimal nutzen lässt. Die Bundesländer können mit eigenen Regeln über die Vorgaben hinweggehen.
