Le perizie e la decisione dei giudici
Secondo quanto stabilito in Appello, Miriam non era in grado di autodeterminarsi nei giorni in cui si consumarono le violenze culminate nella strage. Determinanti sono state le due perizie psichiatriche disposte durante il procedimento, che hanno evidenziato l’incapacità della giovane di comprendere quanto stesse accadendo.
Una valutazione diversa rispetto a quella del primo grado, dove gli stessi elementi non erano stati ritenuti sufficienti per escludere la responsabilità penale.
Miriam era stata trovata dai carabinieri nel suo letto, a pochi metri dai corpi dei fratelli. In un primo momento si pensava fosse l’unica sopravvissuta, ma successivamente fu lei stessa ad ammettere di aver preso parte alle torture e agli omicidi.
La Corte d’Appello ha invece ritenuto che, in quelle circostanze, la ragazza non fosse capace di intendere e di volere, disponendo così l’assoluzione per non imputabilità.

The expert assessments and the judges' decision
According to the Court of Appeals, Miriam was unable to make her own decisions on the days when the violence culminated in the massacre. The two psychiatric examinations ordered during the proceedings were decisive, highlighting the young woman's inability to understand what was happening.

A different assessment than that of the first instance, where the same evidence was not considered sufficient to exclude criminal responsibility.

Miriam was found by the Carabinieri in her bed, a few meters from the bodies of her brothers. Initially, she was believed to be the only survivor, but she later admitted to having participated in the torture and murders.

La Corte d’Appello di Palermo ha assolto la ragazza che partecipò alla strage di Altavilla Milicia, riconoscendola temporaneamente incapace di intendere e di volere al momento dei fatti avvenuti nel febbraio 2024. La giovane, che in primo grado era stata condannata a 12 anni e otto mesi, non è dunque imputabile secondo i giudici della sezione per i minorenni. Durante “un rito di liberazione dal demonio” furono torturati e uccisi una donna e due suoi figli, madre e sorella delle vittime. Era accusata di omicidio plurimo aggravato e occultamento di cadavere. La giovane, durante il procedimento di primo grado, aveva dichiarato che “rifarebbe tutto”, e che non aveva ceduto neanche di fronte alle suppliche della madre che l’aveva pregata di chiamare i carabinieri.
La ragazza, all’epoca dei fatti ancora minorenne, era stata inizialmente ritenuta responsabile della morte della madre, Antonella Salamone, e dei fratelli Kevin ed Emanuel, rispettivamente di 16 e 5 anni, uccisi durante quello che i periti definirono un rito esoterico nella villetta di famiglia. La giovane era stata trovata dai carabinieri nel suo letto, con a pochi metri i corpi dei fratelli. Nel processo d’appello, invece, le perizie mediche, effettuate in due distinti momenti, hanno confermato che sarebbe stata non in grado di comprendere e autodeterminarsi durante la settimana dei fatti. I giudici hanno ritenuto che la sua capacità di intendere fosse solo parziale e, considerata l’età – superiore ai 14 anni ma inferiore ai 18 – hanno applicato gli articoli 98 e 530 del codice penale, escludendo la responsabilità penale della giovane imputata.
