The Reasonable Accommodation Consultants (RACs) at HHS and other agencies need to blow the whistle about the unlawful telework RA denials for people with very severe disabilities. There are law firms that help federal employees blow the whistle safely and
provide their services for free. Multiple HHS employees are reporting that RACs told them that all or almost all telework accommodation requests are getting denied, even for people with very severe health issues who definitely need the telework RA. The RACs say that they themselves feel terrible about what's happening. At HHS these decisions are made at the assistant secretary level or above, at times with a turn around of only a few hours. There is no way there is through medical review of the medical documentation. It's reasonable to think that some of the telework RA denials are unlawful. RACs are the ones seeing numerous unlawful denials each week and can speak to how often it's happening. The are law firms that can help feds blow the whistle safely and provide their services pro bono (for free). The two top ones are Whistleblower Aid and the Government Accountability Project. I'm not a lawyer and this is not legal advice. If you are a federal employee with a disability and your accommodation request for telework got denied see my prior post for free legal resources. Even if you are told by your agency that it's not responsible for your commute, don't give up. There are legal precedents that suggest otherwise.

New OPM Guidance regarding Telework RAs
So I have a great RA Coordinator and I was granted telework due to not having an office nearby being able to accommodate me. Partially I also had a commute restriction before this new guidance. I just got offered a new position in a new directorate but now I’m told I might have to resubmit and scared this new directorate will not grant me accommodations anymore. Will I know if i keep my accommodation or my new location before I get my final offer?
