The Effect of Minor Children’s Choice for Their Previous Naturalized Nationality according to Article 7 of The Kuwaiti Nationality Law <span class="so-article-trans-title" dir="auto"> Translated title: أثر اختيار الأولاد القصّر للمتجنس لجنسيتهم السابقة وفقًا للمادة 7 من قانون الجنسية الكويتي </span>
<p xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" class="first" dir="auto" id="d6414e83">The research aims to reform Article 7 of the Kuwaiti Nationality Law to avoid ambiguity
in the legal effect (which is the loss of Kuwaiti nationality) when minor children
of naturalized Kuwaitis choose their original "foreign" nationality. To achieve this
goal, the research followed the analytical and critical approach. In the first section,
the position of Kuwaiti legislation towards preventing dualism and multilateralism
of nationality is given, with highlights of its failure to a full prevention. In the
second section, Article 7 is reviewed as the most important legislative practice towards
such prevention, through which we conclude that the wording of the article came short
of achieving its goal. The research concludes with the recommendation to reform article
7 to end the ambiguity and establish a clear legal ruling on the legal effect of these
children’s choice for their foreign nationality, as the effect of such choice does
not differ whether it takes place during the period specified in Article 7 or after
its expiry. The value of this research appears in light of the administration's unilateral
application and interpretation of this law without judicial oversight, as all issues
of nationality were considered issues of sovereignty in accordance with Kuwaiti legislation
(Law No. 20 of 1981 establishing the Administrative Court), and the rulings of the
Kuwaiti Court of Cassation.

الذي شابها فيما يتعلق بالأثر القانوني (وهو فقدان الجنسية الكويتية) المترتب على اختيار
الأولاد القصّر للكويتي المتجنس لجنسيتهم الأصلية "الأجنبية". ولتحقيق هذا الهدف، تبنّى
البحث منهج التحليل والنقد، فتناول في المبحث الأول موقف المشرع الكويتي نحو رفض الازدواج
والتعدد، وبيان إخفاقه في منعهما في الوقت ذاته. وتناول المبحث الثاني أحد أهم تطبيقات
المشرع الكويتي لمنع الازدواج والتعدد، وهي المادة 7 من قانون الجنسية الكويتي، وبيّن
أنه قد قصرت صياغة النص عن تحقيق غاية المشرع. وخلص البحث إلى أهمية التعديل التشريعي
لنص المادة 7 لإنهاء الإبهام وإرساء الحكم القانوني الواضح للأثر القانوني المترتب على
اختيار هؤلاء الأولاد لجنسيتهم الأجنبية. حيث إن أثر اختيارهم لجنسيتهم الأجنبية لا يختلف
فيما إذا تم خلال المهلة المحددة في المادة 7، أو بعد انقضائها. وتظهر قيمة هذا البحث
في ظل تفرد الإدارة بتطبيق وتفسير أحكام هذا القانون دونما رقابة من القضاء. حيث إنه
ليس هناك مصدر آخر لتفسير، أو الرقابة على تطبيق الإدارة لهذا القانون بما يتوافق وحقيقة
إرادة المشرع. فقد اعتُبرت جميع مسائل الجنسية من مسائل السيادة وفقا للتشريع الكويتي
(القانون رقم 20 لسنة 1981 بإنشاء المحكمة الإدارية) وأحكام محكمة التمييز الكويتية.
