L'Unità: Famiglia nel bosco, Tribunale ordina l’allontanamento della madre dai tre figli: Garante dell’infanzia contraria
Resta terreno di scontro e polemiche, anche politiche, la sorte dei tre figli di Nathan Trevallion e Catherine Birmingham, quella che è stata ribattezzata dai giornali “famiglia nel bosco”.
Un’ordinanza del Tribunale per i minori dell’Aquila ha disposto che la donna venga portata via dalla struttura della casa famiglia di Vasto, dove era stata trasferiti assieme ai bambini a seguito dell’allontanamento dei tre dalla famiglia e dall’abitazione di Palmoli (Chieti), così come anche i tre bambini verranno trasferiti in un’altra struttura protetta. Una sollecitata dalla direzione della casa famiglia di Vasto dove i bambini sono stati accolti dal 20 novembre.
La notizia, anticipata dal Tg1, è stata confermata anche dall’avvocato di famiglia, Marco Femminella. “C’è un’ordinanza di un tribunale che ha una sensibilità talmente alta che noi abbiamo apprezzato – le parole sarcastiche del legale – che, in pieno svolgimento della consulenza ha deciso di allontanare i bambini e separare la madre. Probabilmente questa consulenza, avrebbe detto Andreotti, non andava bene come stava andando, così l’abbiamo interrotta”, ha aggiunto l’avvocato. Non è chiaro ad questo punto se i test psicologici sui minori saranno effettuati nella struttura protetta o se, invece, in un altro luogo, come inizialmente chiesto anche dal team legale che segue la coppia anglo-australiana: la perizia è in programma oggi e domani.
Contro la decisione del Tribunale si è espressa anche la Garante per l’infanzia Marina Terragni, che ha chiesto di “sospendere” la decisione in attesa di “un ulteriore approfondimento tecnico indipendente” che verifiche “le possibili conseguenze di questo trasferimento-separazione sulla salute dei tre bambini”.
Come detto, la decisione del Tribunale per i minori dell’Aquila ha riacceso lo scontro politico sulla vicenda, già ampiamente strumentalizzata dai partiti di maggioranza, in testa la Lega ma anche la stessa presidente del Consiglio Giorgia Meloni, per attaccare la magistratura e difendere la “sacralità” della famiglia e la libertà di educazione.
Proprio il Carroccio con un post su X ha definito il provvedimento dei magistrati abruzzese un atto di “cattiveria e arroganza”, auspicando che il ministro della Giustizia Carlo Nordio avvii al più presto un’ispezione in tribunale.

An order from the Juvenile Court in L’Aquila has mandated that the woman be removed from the family home in Vasto, where she had been transferred with the children following their removal from the Palmoli (Chieti) family and residence, as well as the three children being transferred to another protected facility. A request from the direction of the family home in Vasto where the children have been housed since November 20th.
The news, anticipated by Tg1, was also confirmed by the family lawyer, Marco Femminella. “There is an order from a court with such sensitivity that we appreciated – the lawyer’s sarcastic words – that, during the course of the consultation, it decided to remove the children and separate the mother. Probably this consultation, as Andreotti would have said, wasn't going well, so we interrupted it,” the lawyer added. It’s not clear at this point whether the psychological tests on the minors will be carried out in the protected facility or if, instead, in another location, as initially requested by the legal team following the Anglo-Australian couple: the expert opinion is scheduled for today and tomorrow.
The Child Rights Defender, Marina Terragni, has also expressed opposition to the decision of the Juvenile Court of L’Aquila, requesting to “suspend” the decision pending “a further independent technical investigation” to verify “the possible consequences of this transfer-separation on the health of the three children.”
As stated, the decision of the Juvenile Court of L’Aquila has reignited the political conflict over the case, widely instrumentalized by the ruling parties, led by the League but also by Prime Minister Giorgia Meloni, to attack the judiciary and defend the “sacredness” of the family and the freedom of education.
The Carroccio (League) used a post on X to define the Abruzzese magistrates’ order as an act of “malice and arrogance,” hoping that Justice Minister Carlo Nordio will initiate an inspection of the court as soon as possible.
