The opposition abstained from voting on the new “gag” bill proposed by Enrico Costa (of Forza Italia), which was passed by the Chamber of Deputies with 127 votes in favor and 82 abstentions. The bill, originally presented in 2022, aims to regulate the publication of court outcomes, particularly for those acquitted or dismissed. Costa pushed strongly for its approval, and with the opposition abstaining, he can now claim success.
The bill mandates that media outlets publish rulings favorable to defendants, with the privacy watchdog (headed by Pasquale Stanzione) having the power to order publication. Costa argued it was a “norm of civilization,” aiming to protect the reputations of the wrongly accused. The opposition expressed concerns about potential pressure on media outlets and a “constitutional doubt” regarding the balance of interests between individual dignity and the right to information.
Despite these reservations, many, including Lega MP Simonetta Matone, supported the bill, viewing it as a necessary and civilized measure against “shameless and arbitrary media manipulation.”
Ultimately, the opposition abstained, recognizing the bill’s potential to further restrict freedom of the press. Specifically, concerns centered around the power of the privacy watchdog and the potential for interference in editorial decisions. While some modifications were made through parliamentary debate, key elements, such as provisions against “slapp” lawsuits, were not included, leading to further abstentions.
