Estafa del CBU: Por qué «devolver» un dinero que recibiste por error puede llevarte a la justicia

Imagina que abres tu aplicación bancaria y descubres que tienes 500.000 pesos extra. No sabes de dónde vinieron, pero a los cinco minutos recibes un mensaje por WhatsApp: «Disculpa, me equivoqué de cuenta y te envié el dinero por error, ¿podrías transferirlo a este CBU?». Aunque tu instinto sea actuar de buena fe y devolverlo, ni se te ocurra hacerlo. Estás a punto de caer en una estafa triangular.

¿Qué es la estafa triangular y por qué te usan como «mula»?

En este esquema de fraude, el ciberdelincuente te utiliza como una mula digital. El proceso es simple pero efectivo: el estafador le vende un producto inexistente a una tercera persona por el monto mencionado (en este caso, 500.000 pesos) y le brinda tu CBU para el pago.

El delincuente hace esto porque no quiere blanquear su propia cuenta ni quedar vinculado directamente con la transacción ilegal. Cuando tú recibes el dinero y luego lo transfieres a la cuenta que el estafador te indica por WhatsApp, estás «cerrando el triángulo». En ese momento, te conviertes involuntariamente en parte de la estafa, ayudando al delincuente a cobrar el dinero de una venta falsa.

Las graves consecuencias legales en Argentina

Actuar de buena fe no siempre te protege ante la ley. Si decides devolver el dinero por tu cuenta o, peor aún, te lo gastas, podrías enfrentar serios problemas legales.

En la justicia argentina, si un fiscal detecta que ese dinero producto de un fraude pasó por tu cuenta y tú lo movilizaste, puedes terminar imputado por fraude. No importa si no tuviste una mala intención; el registro digital muestra que participaste en la maniobra.

Guía de acción: Qué hacer si recibes una transferencia sospechosa

Para protegerte y evitar que este problema escale, debes seguir estos pasos estrictamente:

  • No toques el dinero: Déjalo exactamente donde está en tu cuenta.
  • No realices la devolución tú mismo: Nunca transfieras el monto a un CBU que te pasen por WhatsApp o redes sociales.
  • Comunícate con tu entidad financiera: Llama a tu banco o fintech y solicita explícitamente un «reverso digital». Pídeles que ellos se encarguen de reasignar los fondos y devolver el dinero directamente a la cuenta de origen. De esta forma, queda un registro oficial de que el banco hizo el movimiento y tú quedas cubierto legalmente.
  • Bloquea el contacto: Una vez que hayas delegado el problema a tu banco, bloquea el número de la persona que te contactó para presionarte.
