Preparing for the Worst: The Possible Extradition of Gabriel Pombo Da Silva to Italy

In December 2025, our compañero was detained under a European Arrest Warrant (an EAW issued by Italy). The arrest lasted five hours until the Investigating Judge Pedraz granted him provisional release, subject to reporting requirements and prohibition from leaving the country. This European Arrest Warrant derived from one of the many Italian repressive operations: the “Operation Scripta Manent” of 2016, which resulted in Gabriel receiving a two-year prison sentence for incitement to commit a crime in 2022. At the end of November last year, the Turin court announced that the alternative to imprisonment requested by the defense attorney would not be accepted due to a “lack of self-critique of his own values” (a nice way of saying the lack of remorse). This has paved the way for the sentence to be served out in prison. That is why the European Arrest Warrant was issued. Judge Pedraz considered this crime to be one of opinion and therefore did not order imprisonment, instead requesting specific documentation from both parties.

A few days ago, a ruling signed by the same judge was issued. Siding partially with one party and partially with the other, the judicial decision opens up the possibility for Gabriel’s possible extradition to Italy if certain conditions are met.

At the moment, we are not interested in discussing the legal details, although it is interesting to see how the state uses its convoluted “truths” to justify the witch hunt. This is an extremely contradictory ruling filled with lies, where the Italians have played on the psychology of propaganda by extrapolating words and concepts from Gabriel’s conviction to justify their request.

This ruling closes the preliminary investigation. It is not final, and the defense attorney is appealing. Although there are no legal grounds for Gabriel to have to serve the sentence in Italian prisons, it is not complicated to see this ruling as one of the many tactics employed by the Italian state to continue collecting its war trophies.

In a few weeks, the prosecutor and the defense attorney will present their arguments at a hearing in the National Court.

We have always known legal reasons will not prevail, but political and personal revenge will. The dignified fighters have to be punished in an exemplary manner. That is why we are not surprised, and we are preparing for the worst-case scenario, stronger than ever.
