L’ennesima sconfitta in tribunale per Donald Trump e la sua amministrazione, ma soprattutto per la strategia della Casa Bianca di utilizzare i dazi come arma di ricatto contro i presunti “alleati” di Washington.
Il collegio di giudici federali della Corte per il Commercio Internazionale ha stabilito che i dazi del 10 per cento imposti dal presidente Trump lo scorso febbraio contro tutti i Paesi sono illegittimi.
Si tratta dei dazi che la Casa Bianca introdusse a seguito dell’attesa sentenza della Corte Suprema, a maggioranza conservatrice, che bocciò come illegittimi i dazi imposti ad aprile 2025 da Trump a praticamente tutti i Paesi del globo, causando una crisi dei mercati e soprattutto spingendo molti governi ad avviare complicate trattative con Washington per abbassarli. A febbraio la Corte Suprema li aveva definiti illegittimi in quanto introdotti con una legge emergenziale e senza l’approvazione del Congresso.
In risposta alla sentenza, Trump aveva introdotti nuovi dazi del 10 per cento utilizzando come “base legale” per la manovra una legge diversa, che gli consentiva di approvare nuovi dazi fino al 24 luglio prima di un voto del Congresso.
Anche questi dazi sono stati però giudicati illegittimi a seguito di un ricorso presentato da due società: l’amministrazione Trump farà probabilmente ricorso e dunque anche questo caso potrebbe arrivare alla Corte Suprema.
Proprio nel pomeriggio di giovedì Trump aveva tenuto un colloquio telefonico con la presidente presidente della Commissione Europea Ursula von der Leyen, in cui il tycoon è tornato a minacciare l’introduzione di nuovi pesanti dazi doganali: “Ho atteso pazientemente che l’Ue adempisse ai suoi obblighi derivanti dallo storico accordo commerciale siglato a Turnberry, in Scozia, il più grande accordo commerciale di sempre! È stata fatta la promessa che l’Ue avrebbe rispettato la sua parte dell’accordo e, come previsto, avrebbe azzerato le tariffe doganali! Ho accettato di darle tempo fino al 250° anniversario del nostro Paese (il 4 luglio, ndr), altrimenti, purtroppo, le tariffe aumenterebbero vertiginosamente”, le parole di Trump.

Yet another court defeat for Donald Trump and his administration, but especially for the White House’s strategy of using tariffs as a blackmail weapon against Washington’s alleged “allies.”

The federal panel of judges at the International Trade Court ruled that the 10 percent tariffs imposed by President Trump last February on all countries are illegal.

These were the tariffs that the White House introduced following the expected ruling by the conservative-majority Supreme Court, which dismissed as illegal the tariffs imposed in April 2025 by Trump on practically all countries of the globe, causing a market crisis and, above all, pushing many governments to initiate complex negotiations with Washington to lower them. In February, the Supreme Court had declared them illegal because they were introduced through an emergency law and without the approval of Congress.

In response to the ruling, Trump introduced new 10 percent tariffs, using a different law to justify the maneuver, which allowed him to approve new tariffs up to July 24 before a vote by Congress.

These tariffs were also ruled illegal following a lawsuit filed by two companies: The Trump administration will likely appeal and therefore this case could also go to the Supreme Court.

Just on Thursday afternoon, Trump had held a telephone conversation with the President of the European Commission, Ursula von der Leyen, in which the tycoon returned to threatening the introduction of new heavy customs tariffs: “I have patiently waited for the EU to fulfill its obligations stemming from the historic trade agreement signed in Turnberry, Scotland, the largest trade agreement ever! The promise was made that the EU would fulfill its part of the agreement and, as expected, would eliminate tariffs! I agreed to give it until the 250th anniversary of our country (July 4th, ed.), otherwise, unfortunately, the tariffs would increase dramatically,” Trump said.
